Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the Wexlo platforms operated by Wexlo, a business name operated by a self-employed individual registered in Malta. The platforms include the website at wexlo.duckdns.org (“Wexlo”) and wexlopro.duckdns.org (“Wexlo Pro”), and any related services.

Please read these Terms carefully before using our services. By creating an account or using any part of the platform, you confirm that you have read, understood, and agree to be bound by these Terms.

1. Acceptance of terms

If you do not agree with any part of these Terms, you must not use our platforms. We reserve the right to update these Terms at any time. Continued use of the platform after changes are published constitutes acceptance of the revised Terms. We will notify registered users of significant changes by email.

You must be at least 18 years old to create an account or list a property on Wexlo.

2. The platforms

Wexlo (wexlo.duckdns.org)

Wexlo is a marketplace for private property owners in Malta and Gozo to advertise their properties directly to buyers and renters. Wexlo does not act as an estate agent, broker, or party to any property transaction. All transactions are between the listing owner and the buyer or renter directly.

Wexlo Pro (wexlopro.duckdns.org)

Wexlo Pro is a subscription-based platform exclusively for licensed real estate agents holding a valid warrant issued by the Malta Estate Agents Warrant Board. Wexlo Pro is not available to private individuals. Wexlo reserves the right to verify agent credentials and to suspend or terminate accounts that do not meet the eligibility requirements.

3. Accounts

• You are responsible for maintaining the confidentiality of your account credentials.
• You must provide accurate and truthful information when registering.
• You must not create multiple accounts or impersonate another person or entity.
• You must notify us immediately if you suspect unauthorised access to your account.
• We may suspend or terminate your account if we suspect a breach of these Terms.
• One account per person. Business accounts on Wexlo Pro are tied to the registered agent.

4. Listings

Owner listings (Wexlo)

• Only private property owners may list on Wexlo. Listings by estate agents are not permitted and will be removed.
• All information in your listing must be accurate, complete, and not misleading.
• You must be the owner of the property, or have explicit authority from the owner to advertise it.
• Photos and other media must belong to you or you must have the right to use them.
• Basic listings are free and active for 60 days. Standard listings are active for 90 days after payment.
• Wexlo reserves the right to edit, suspend, or remove any listing that violates these Terms.

Agent listings (Wexlo Pro)

• Listings must relate to properties the agent is actively mandated to sell or rent.
• All mandatory disclosures under Maltese property law must be included.
• The number of active listings is subject to the subscription plan in place.

5. Prohibited conduct

You must not use the platform to:

• Post false, misleading, or fraudulent listings
• Advertise a property you do not own or have no authority to advertise
• Collect deposits or advance payments through fraudulent means
• Scrape, copy, or reproduce listings or content from the platform without permission
• Send unsolicited commercial messages to other users
• Attempt to gain unauthorised access to any part of the platform
• Use the platform for money laundering, fraud, or any unlawful purpose
• Interfere with the operation of the platform or its servers
• Post content that is defamatory, discriminatory, obscene, or otherwise unlawful
• Circumvent any payment or access controls

Breaches of this section may result in immediate account termination and may be reported to the Malta Police Force or other relevant authorities.

6. Payments and refunds

Payments on Wexlo are processed securely by Stripe. By making a payment, you agree to Stripe's terms of service.

One-time listing fees (Wexlo)

• Standard listing fees (€29) and Boost fees (€19) are non-refundable once the listing goes live.
• If a listing is removed by Wexlo due to a Terms breach, no refund will be issued.
• If a listing is removed by Wexlo due to a platform error, a credit or refund will be offered.

Subscriptions (Wexlo Pro)

• Monthly subscriptions are billed in advance and renew automatically until cancelled.
• You may cancel your subscription at any time. Access continues until the end of the paid billing period.
• No partial-month refunds are issued on cancellation.
• If Wexlo terminates your account due to a breach of these Terms, no refund will be issued.

7. Intellectual property

All platform content created by Wexlo — including design, code, logos, and copy — is the intellectual property of Wexlo and may not be reproduced without written permission.

By uploading photos, descriptions, or other content to the platform, you grant Wexlo a non-exclusive, royalty-free licence to display and reproduce that content for the purpose of operating and promoting the platform. You retain ownership of your content and may remove it at any time by deleting your listing.

You confirm that any content you upload does not infringe the intellectual property rights of any third party.

8. Disclaimers

Wexlo is a marketplace platform. We do not verify the accuracy of individual listings, the legal title to properties advertised, or the identity of all users. We strongly recommend that buyers engage a notary to conduct due diligence before entering into any property transaction.

The platform is provided “as is” without warranties of any kind, express or implied. We do not guarantee uninterrupted access to the platform or that it will be free from errors.

Wexlo is not a party to any transaction between buyers and sellers. Any dispute arising from a property transaction is between the parties to that transaction.

9. Limitation of liability

To the maximum extent permitted by Maltese law, Wexlo shall not be liable for:

• Any loss or damage arising from reliance on listing information
• Any financial loss resulting from a fraudulent listing or contact
• Loss of data, revenue, or profits
• Any indirect, incidental, or consequential damages

Our total liability to you for any claim arising from your use of the platform shall not exceed the amount paid by you to Wexlo in the 12 months preceding the claim.

10. Termination

You may delete your account at any time from your account settings. We may suspend or terminate your access to the platform without notice if we reasonably believe you have breached these Terms, engaged in fraud, or misused the platform in any way.

On termination, your listings will be removed and your access to the platform will cease. Provisions of these Terms that by their nature should survive termination will continue to apply.

11. Governing law

These Terms are governed by the laws of Malta. Any disputes arising from these Terms or your use of the platform shall be subject to the exclusive jurisdiction of the Maltese courts.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
